Privacy Policy

Datenschutzerklärung (GDPR / DSGVO)

We take the protection of your personal data seriously and process it only in accordance with the EU General Data Protection Regulation (GDPR) and applicable German law. This policy explains what data we process, why, on what legal basis, and what rights you have.

1. Controller

The controller responsible for data processing on this website is: Amira Pictures (Amir Morsali), Kantstraße 67, 10627 Berlin, Germany. E-mail: info@biuff.com. BIUFF (Berlin International Underground Film Festival) is a public initiative operated by Amira Pictures.

2. Visiting this website (hosting & server logs)

This website is hosted by Vercel Inc. (San Francisco, USA). When you access the site, your browser automatically transmits technical data (e.g. IP address, date and time, browser type, referring page) that is processed to deliver the site securely and reliably. Legal basis: Art. 6(1)(f) GDPR (our legitimate interest in a secure, functioning website). Data transfers to the USA are safeguarded by the EU Standard Contractual Clauses and, where applicable, the EU–US Data Privacy Framework.

3. Web analytics (Vercel Web Analytics)

We use Vercel Web Analytics to understand, in aggregate, how the site is used (e.g. page views, referrers, approximate country). This tool is privacy-friendly and cookieless: it sets no cookies, does not store identifiers on your device, does not track you across other websites, and does not build individual profiles. Because no personal data is stored on your device and no cross-site tracking takes place, this processing relies on Art. 6(1)(f) GDPR (our legitimate interest in measuring and improving our website).

4. Contact by e-mail / contact form

If you contact us via the contact form or by e-mail, we process the data you provide (e.g. name, e-mail address, message) solely to handle your enquiry. Legal basis: Art. 6(1)(b) GDPR where your request relates to a contract, otherwise Art. 6(1)(f) GDPR (our legitimate interest in responding to enquiries). This data is deleted once your enquiry has been fully dealt with, unless statutory retention periods apply.

5. Purchases & payment processing (Stripe)

When you purchase a package, service or ticket, payment is processed by Stripe Payments Europe, Ltd. (Ireland). The data required to complete the transaction — such as your name, e-mail address, billing address and payment details — is transmitted to and processed by Stripe under its own privacy policy. We never receive or store your full card details. Legal basis: Art. 6(1)(b) GDPR (performance of the contract).

6. Order confirmation e-mails (Resend)

Confirmation and order-related e-mails are delivered through Resend (email delivery service). For this purpose your e-mail address and the details of your order are processed. Legal basis: Art. 6(1)(b) GDPR (performance of the contract).

7. Order records (Google Workspace)

We keep a record of purchases (e.g. buyer name, e-mail, product, amount, date) in Google Workspace / Google Sheets (provided by Google Ireland Limited) in order to fulfil orders and meet our accounting and tax obligations. Legal basis: Art. 6(1)(b) GDPR (performance of the contract) and Art. 6(1)(c) GDPR (compliance with legal retention duties, e.g. § 147 AO / § 257 HGB, which can require retention for up to 10 years).

8. Film submissions (Festhome)

Films were submitted to BIUFF through the external platform Festhome. Any data you provided during submission on that platform is governed by Festhome's own privacy policy. Where we use submission data (e.g. your name, film title and contact e-mail) to administer the festival and contact you, the legal basis is Art. 6(1)(b) and Art. 6(1)(f) GDPR.

9. Recipients & international transfers

Personal data is shared only with the processors named above (Vercel, Stripe, Resend, Google) strictly for the purposes described, on the basis of data-processing agreements. Some of these providers are based in or process data in the USA; such transfers are safeguarded by EU Standard Contractual Clauses and/or the EU–US Data Privacy Framework.

10. Retention

We keep personal data only as long as necessary for the purposes described or as required by law. Order and invoice data is retained for the statutory periods (generally 6–10 years under German commercial and tax law); other data is deleted once its purpose no longer applies.

11. Your rights

Under the GDPR you have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing (Art. 21). To exercise any of these, contact info@biuff.com. You also have the right to lodge a complaint with a supervisory authority — for us this is the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit).

12. Data security

This website is served exclusively over an encrypted TLS/SSL connection (HTTPS) to protect data transmitted between your browser and our site.

Cookie Policy

We keep cookies to an absolute minimum. We do not use advertising or cross-site tracking cookies, and we do not sell your data. Because we only use strictly-necessary cookies (during checkout) together with cookieless analytics, no cookie consent banner is currently required. If this ever changes, we will add a consent banner accordingly.

Strictly necessary (checkout)

When you proceed to payment, our payment provider Stripe may set cookies that are strictly necessary to process the payment securely and to prevent fraud. These are required for the checkout to function and, under § 25(2) TTDSG, do not require consent.

Analytics — cookieless

Our analytics tool (Vercel Web Analytics) is cookieless: it sets no cookies and stores no identifiers on your device. See section 3 of our Privacy Policy for details.

No advertising or tracking cookies

We do not use advertising cookies, marketing pixels, or third-party cross-site tracking of any kind.

Terms of Service

Allgemeine Geschäftsbedingungen (AGB)

These terms govern the purchase of participation packages, individual services and tickets offered on biuff.com by Amira Pictures (Amir Morsali), Kantstraße 67, 10627 Berlin, Germany (“BIUFF”, “we”, “us”).

1. Scope

These terms apply to all contracts concluded through this website between us and you as a customer (consumer or business). Your statutory consumer rights remain unaffected and always take precedence where they are more favourable to you.

2. Selection is free and never for sale

A film's selection into the BIUFF Founding Selection is decided on the merits of the work and is free of charge. The packages, services and tickets offered here are optional and are about participation, presentation and visibility only. Purchasing any of them does not influence the reviewing jury, does not affect any judging decision, and does not guarantee any award or result.

3. Services offered

We offer, among others: Founding Selection screening participation, written jury feedback, digital spotlight features, printed certificates and laurels, a Founding Filmmaker badge, bundled packages, and audience / event tickets. The specific contents and price of each item are shown on the relevant product on this website at the time of order.

4. Conclusion of contract

By selecting an item and completing payment via Stripe Checkout, you make a binding offer to purchase it. The contract is concluded when we confirm your order — at the latest when you receive our order-confirmation e-mail. The order text (your specific order) is not stored by us in individually retrievable form beyond our records; please keep your confirmation e-mail.

5. Prices and payment

All prices are stated in euros (€) and include the applicable statutory German value-added tax (VAT). Payment is handled by our payment provider Stripe using the methods shown at checkout. Payment is due immediately upon conclusion of the contract.

6. Performance & timing

Digital services (e.g. screening participation, spotlight features, feedback) are delivered in connection with the Founding Edition, whose online showcase is planned for late October 2026 and whose closing event in Berlin is planned for early November 2026. Physical items (certificate and laurels) are produced and mailed to the address you provide. Dates and the streaming platform may still be adjusted; we will inform affected customers of any material change.

7. Right of withdrawal

As a consumer you have a statutory right of withdrawal for distance contracts, subject to the exceptions set out in our separate Right of Withdrawal notice below. Please read it carefully, as some items (e.g. dated event tickets and digital services you ask us to begin immediately) are exempt from, or lose, the withdrawal right.

8. Liability

We are liable without limitation for intent and gross negligence, and for damages arising from injury to life, body or health, as well as under the German Product Liability Act. For slight negligence we are liable only where a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely) is breached, and then limited to the typical, foreseeable damage. Any further liability is excluded.

9. Applicable law & jurisdiction

These terms and any contract concluded under them are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

10. Severability

Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

Right of Withdrawal & Refunds

Widerrufsbelehrung für Verbraucher

If you are a consumer (a natural person entering into the contract for purposes outside your trade or profession), you have a statutory right to withdraw from distance contracts, subject to the exceptions below.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of conclusion of the contract (for services and digital content) or, for physical goods, from the day on which you or a third party named by you (other than the carrier) takes possession of the goods.

How to withdraw

To exercise your right of withdrawal, you must inform us — Amira Pictures (Amir Morsali), Kantstraße 67, 10627 Berlin, Germany, e-mail info@biuff.com — of your decision to withdraw by a clear statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for supplementary costs arising from your choice of a delivery type other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We will make the reimbursement using the same means of payment you used for the initial transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement.

Exception — dated event & ticket services

The right of withdrawal does not apply to contracts for the provision of services in connection with leisure activities where the contract provides for a specific date or period of performance (§ 312g(2) no. 9 BGB). This covers, in particular, tickets to the physical Berlin event and other dated event access. Such purchases are binding and non-refundable once made, except where the event itself is cancelled by us.

Exception — digital services begun with your consent

For digital services (e.g. a spotlight feature, written feedback, or screening participation) that you ask us to begin during the withdrawal period, your right of withdrawal lapses once we have fully performed the service, provided you expressly consented to us beginning performance and acknowledged that you thereby lose your right of withdrawal (§ 356(4) BGB). Where a service has only partly been performed at the time of your withdrawal, you owe a proportionate amount for the part already provided.
